In the event that we do not enforce our rights set out in these Conditions of Use this shall not be taken to be a waiver of those rights unless we have agreed to this is writing.
In these Terms and Conditions ‘We’ or ‘Our’ refers to Pink Gem Designs and ‘You’ or ‘Your’ refers to any customer of Pink Gem Designs.
You must ensure that your personal details are correct when registering on our website and each time you place an order. You can update your personal details such as your postal or email address by logging into your account on the website and clicking on the ‘Edit Account’ link under the ‘My Account’ heading.
You must keep your username and password secure and not reveal these details to anyone else.
You must contact us immediately if you suspect these details have become known to anyone else.
Product Prices & Description
We reserve the right to adjust our product prices at any time without prior notice. We will of course honour the prices for any orders submitted by you prior to the changes being uploaded to the website.
We will always endeavour to ensure that the description and pricing of our products is accurate. In the event that you place an order based on an incorrect price displayed on our website or in any of our literature we will give you the opportunity to confirm your order at the correct price or cancel your order.
The images displayed on our website are not actual size however the approximate size in millimetres for each product is clearly displayed alongside each image.
The images of our products displayed on the website are of a low resolution. The actual stamps and downloadable images will provide clear crisp images.
We accept payment on-line by PayPal and also by most debit or credit cards via PayPal.
For orders submitted by post or over the telephone we also accept payment by banker’s cheque or postal order. This facility is not available to customers from outside the UK.
Acceptance / Refusal of Orders
When you submit an on-line order via the website an automatic confirmation will be sent to the email address that you have registered with us.
This automatic confirmation is to indicate that we have received your order and does not confirm that a contract exists between us at that stage.
Once we have checked and processed your order a formal contract will exist between us. This applies to on-line and postal / telephone orders.
We do not guarantee that the products shown on our website will be available at all times however we will endeavour to ensure that details are kept up to date.
We reserve the right to delay or refuse orders when insufficient details have been provided by you for us to process the order or where there is any suspicion of fraud.
When we refuse an on-line order we will refund any monies paid within 5 working days to the PayPal account provided by you when submitting the order. Where an order which has been submitted by post is refused this will be returned to the customer by post and will be dispatched within 5 working days of receipt by us.
Postage & Packaging
Our current postage & packaging rates can be viewed by clicking on the ‘Postage & Packaging’ link under the ‘Articles’ heading on the website.
Orders for dispatch to destinations outside the UK will be sent by airmail.

Delivery & Returns
Once cleared funds have been received the products that you have ordered will be shipped to the postal address that you have registered with us.
If the order is to be delivered to a different address this must be specified by you at the time that your order is submitted.
All products are checked for quality prior to shipping to ensure they are free of any defects.
We will always obtain proof of posting when shipping products to you.
We ship our stamps worldwide and following receipt of cleared funds we will normally send the goods within 24 hours excluding Sundays and UK public holidays. If there are any changes to dispatch times during holiday periods etc this will be clearly stated on the website.
Items shipped to UK destinations will be sent by first class post. The Post Office has a delivery aim of one working day, however this is not guaranteed.
Items shipped to destinations outside the UK will be sent by airmail. The post office has a delivery aim of 3 working days to Western European destinations, 5 days to Eastern European destinations and 7 working days for all destinations outside Europe, however these times are not guaranteed. Please note that working days exclude weekends and public holidays.
Delivery times can sometimes be substantially more than the target times referred to above and packages sent to destinations outside the UK may take up to 4 weeks to arrive or even longer than this on rare occasions.
If your goods arrive in a damaged condition you must retain the goods and all packaging as the Post Office may wish to see them to substantiate any claim for compensation. The Post Office may refuse a claim for compensation if goods and packaging are not available for inspection. Please take a photograph of the damaged goods and packaging and contact us as soon as possible. If goods are damaged in transit this is beyond our reasonable control and we cannot therefore be held responsible, however we will do our best to help.
If you are unhappy with any product for any reason, returns will be accepted within 14 days of delivery. Items must be unused and returned in the original packaging for a full refund excluding the original postage & packaging cost. Customers will be responsible for return postage costs unless the goods are defective in which case we will refund the cost of this.
You will also be responsible for the safe return of the goods. Replacement goods or a refund can only be provided on the safe return of the original goods.
Customs Charges and Local Taxes
For orders to be dispatched to destinations outside the UK you will you responsible for any customs charges or local taxes in the destination country.
Delayed & Lost Packages
Once goods have been dispatched, the delivery time is beyond our control as we are in the hands of the postal service. Customers must therefore allow for delays during busy periods, periods of industrial action affecting postal or transportation services or during severe weather conditions etc.
Delays may also be experienced if packages are intercepted by Customs for checking in the destination country.
Packages which have not arrived within 15 working days from the date of dispatch to UK destinations, 20 working days to European destinations or 25 working days to destinations outside Europe are considered by the Post Office to be lost. Please note that working days excludes weekends and public holidays.
After this time has elapsed we will submit a claim to the Post Office for compensation following which they may contact you to confirm that you have not received the package.
The UK Post Office may take up to 30 days to investigate claims for lost or damaged packages sent to UK destinations or up to 90 days for items sent to destinations outside the UK.
We understand that customers may become frustrated when packages are delayed or lost. Please remember that in these circumstances the postal service has not only failed you but failed us as well and that such problems are beyond our reasonable control.
We will only send replacement goods or issue a refund when the Post Office has reimbursed us for the lost package.
If you are not prepared to accept this then please refrain from ordering from us.
Cancellation & Refunds
In the event that we supply products to you which are not as ordered or are found by us to be defective our liability shall be limited to replacing the product or issuing a refund if the product is no longer available.
Once a refund has been offered by us and accepted by you we will process the refund within 5 working days. We will only make refunds to the PayPal account provided by you when you submitted the order.
We shall not be liable for any consequential loss or damage suffered by you in the event that products are not available or from any delay in delivering your order by UK or overseas postal services.
Events Beyond Our Reasonable Control
We shall not be liable for any delay or failure by us to fulfil our obligations set out in these Terms & Conditions if that delay or failure is due to circumstances beyond our reasonable control. This includes acts of god, war, civil disorder, severe weather conditions or industrial disputes.
We will always aim to provide high quality products and the best possible service to our customers. Occasionally we may get things wrong and if this happens we ask that you give us the opportunity to put things right before cancelling your order or requesting a refund.
If you are dissatisfied with our products or service in any way please use the ‘Contact Us’ link on the website to notify us of the problem. We will normally respond to all complaints and queries within 24 hours and endeavour to resolve any problem to your satisfaction as quickly as possible.

You may use our stamps and downloadable digital products for any projects that you wish to sell on or provide as gifts but all artwork must be individually hand stamped or printed. There are no limits to the number of projects that you can make.
We would ask that you acknowledge Pink Gem Designs when selling on your creations although this is not essential.
You must not use our products to produce images and sell them yourself.
You must not reproduce our images by any means including but not limited to mechanical, electronic or photocopying methods as this would be in breach of our copyright.
